This document (as well as other documents mentioned herein) regulates the conditions governing the use of this Website (keygara.shop) and the purchase or acquisition of products and/or services therein (hereinafter, Conditions).
For the purposes of these Conditions, it is understood that the activity KeyGara develops through the Website includes the sale of products via electronic commerce.
In addition to reading these Conditions, before accessing, browsing and/or using this website, the User must have read the Legal Notice and General Conditions of Use, including the Cookie Policy, and the Privacy and Data Protection Policy of KeyGara. By using this Website or by making and/or requesting the acquisition of a product and/or service through it, the User consents to be bound by these Conditions and by all of the above, so if you do not agree with all of this, you should not use this Website.
Likewise, it is reported that these Conditions could be modified. The User is responsible for consulting them every time they access, browse and/or use the Website since those that are in force at the time the acquisition of products and/or services is requested will be applicable.
2. THE USER
Access, navigation, and use of the Website confers the condition of user (hereinafter referred to, indistinctly, individually as User or jointly as Users). Therefore, from the moment navigation begins on the Website, all the Conditions established herein are accepted, as well as their subsequent modifications, without prejudice to the application of the corresponding mandatory legal regulations according to the case.

The Website is directed at Users resident in Spain and the European Union. KeyGara does not ensure that the Website complies with legislations of countries outside this scope. KeyGara declines all responsibility that may derive from such access from outside these territories.
3. PURCHASE OR ACQUISITION PROCESS
Registered Users may buy on the Website by the established means and forms. They must follow the online purchase and/or acquisition procedure of KeyGara, during which several products and/or services can be selected and added to the cart, basket or final purchase space and, finally, click on: “Place Order”.
Likewise, the User must fill in and/or check the information requested in each step, although, during the purchase process, before making the payment, the purchase data can be modified.
Subsequently, the User will receive an email confirming that KeyGara has received their order or request for purchase, that is, the Order Confirmation. And, where appropriate, they will also be informed by email when their purchase is being shipped.
Once the purchase procedure has concluded, the User consents that the Website generates an electronic invoice that will be sent to the User via email. Likewise, the User can, if they wish, obtain a paper copy of their invoice, requesting it from KeyGara using the contact spaces of the Website.
The User acknowledges being aware, at the time of purchase, of certain particular conditions of sale concerning the product and/or service in question which are shown next to the presentation or image of the product (name, price, components, weight, quantity, color, details, etc.) and acknowledges that the realization of the purchase order materializes the full and complete acceptance of the particular conditions of sale applicable to each case.
Unless expressly stated otherwise, KeyGara is not the manufacturer of the products sold on the Website. While KeyGara makes great efforts to ensure that the information shown on the Website is correct, sometimes the packaging and/or materials and/or components of the products may contain additional or different information from that which appears on the Website. Therefore, the User must not only consider the information supplied by the Website, but also the information available on the labeling, warnings and/or instructions accompanying the product.
4. AVAILABILITY
All purchase orders received by KeyGara through the Website are subject to the availability of the products. If difficulties regarding the supply of products occur or if there are no products in stock, KeyGara undertakes to contact the User and reimburse any amount that may have been paid.
5. PRICES AND PAYMENT
The prices displayed on the Website are final, in Euros (€) and include taxes, unless by legal requirement, especially regarding VAT, a different issue is pointed out and applied.
Shipping costs are included in the final prices of the products as shown on the Website, unless otherwise stated. KeyGara performs delivery and/or shipping services through various third-party shipping partners.
Prices may change at any time, but possible changes will not affect orders or purchases with respect to which the User has already received an Order Confirmation.
The accepted means of payment will be:

KeyGara uses all means to guarantee the confidentiality and security of payment data transmitted by the User during transactions through the Website. As such, the Website uses a secure payment system SSL (Secure Socket Layer).
Credit cards will be subject to checks and authorizations by the issuing bank; if said entity does not authorize the payment, KeyGara will not be responsible for any delay or non-delivery and will not be able to formalize any contract with the User.
Bank Transfer: Orders selected with this payment method will be reserved for 5 calendar days pending receipt of funds. Cash on Delivery: If this method is available and selected, the User agrees to pay the exact amount in cash to the carrier upon delivery. KeyGara reserves the right to disable this method for Users who have rejected packages in the past.
6. DELIVERY
Deliveries will be made to the following territories: Spain, European Union, and International markets where shipping is available.
Except for unforeseen circumstances or force majeure, the purchase order will be delivered within the period indicated on the Website according to the shipping method selected by the User and, in any case, within a maximum period of 30 calendar days from the date of the Order Confirmation.
If for any reason attributable to KeyGara, the delivery date cannot be met, we will contact the User to inform them of this circumstance and they may choose to proceed with the purchase by establishing a new delivery date or cancel the order with a full refund of the price paid.
If it is impossible to deliver the order due to the absence of the User, the carrier may leave a notice explaining where the order is and how to get it delivered again. If 30 days elapse since the order is available for delivery and it has not been delivered due to a cause not attributable to KeyGara, we will understand that the User wishes to withdraw from the contract and it will be considered terminated.
VAT Rules: In accordance with current laws, purchase orders for delivery will be understood to be located in the territory of application of Spanish VAT if the delivery address is in Spanish territory. For orders destined for other EU Member States, the VAT applicable will be that in force in said Member State (OSS System). For orders destined for the Canary Islands, Ceuta, and Melilla, or outside the EU, deliveries may be exempt from VAT but subject to import taxes and customs duties payable by the User at the destination.
7. TECHNICAL MEANS TO CORRECT ERRORS
The User is informed that if they detect that an error has occurred when entering data necessary to process their purchase request on the Website, they may modify them by contacting KeyGara or through their personal account on the Website.
8. RETURNS AND RIGHT OF WITHDRAWAL
Right of Withdrawal (14 Days) The User has the right to withdraw from the purchase within a period of 14 calendar days without the need for justification. This period expires 14 days from the day the User (or a third party indicated by them) acquires material possession of the goods.
To exercise this right, the User must notify KeyGara. You may use the withdrawal form model provided, but its use is not mandatory.
Refunds: In case of withdrawal, KeyGara will reimburse the User for all payments received, including shipping costs (with the exception of additional costs chosen by the User for a shipping mode other than the least expensive ordinary delivery mode offered). We will proceed to make such reimbursement using the same means of payment used for the initial transaction. KeyGara may withhold reimbursement until it has received the goods back or until the User has supplied evidence of having sent back the goods.
Return Address: The User must return or deliver the goods to KeyGara at: Pasaje Venezuela 4, Piso 2, 5, without undue delay and, in any case, no later than 14 calendar days from the date they communicate their decision to withdraw. The User will bear the direct cost of returning the goods.
Exceptions: The right of withdrawal will not apply to:
Personalized items.
Sealed goods that are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.
Legal Guarantee: The User benefits from a legal guarantee of conformity for the products for a period of three years from delivery, in accordance with current consumer regulations.
9. EXONERATION OF LIABILITY
Unless otherwise provided by law, KeyGara accepts no responsibility for the following losses, regardless of their origin:
Any losses that were not attributable to any breach on its part.
Business losses (including lost profits, revenue, contracts, anticipated savings, data, loss of goodwill or unnecessary expenses incurred).
Technical failures due to fortuitous causes that prevent normal operation of the service via the internet.
KeyGara will not be responsible for any breach or delay in the fulfillment of any of the obligations assumed, when it is due to events that are beyond its reasonable control (“Force Majeure”), including strikes, natural disasters, or impossibility of the use of transport systems.
10. WRITTEN COMMUNICATIONS
By using this Website, the User accepts that most communications with KeyGara are electronic (email or notices published on the Website). For contractual purposes, the User consents to use this electronic means of communication.
11. WAIVER
No waiver by KeyGara of a specific right or legal action shall imply a waiver of other rights or actions derived from a contract or the Conditions.
12. ENTIRE AGREEMENT
These Conditions and any document expressly referred to in them constitute the entire agreement between the User and KeyGara.
13. DATA PROTECTION
Personal data provided by the User during a transaction will be treated in accordance with the Privacy Policy.
14. APPLICABLE LEGISLATION AND JURISDICTION
Access to and use of this Website and product purchase contracts shall be governed by Spanish legislation. Any controversy will be submitted to the non-exclusive jurisdiction of the Spanish courts and tribunals.
15. COMPLAINTS AND CLAIMS
